KCI Says That Court Of England & Wales Upholds Injunction Against Smith & Nephew

Kinetic Concepts, Inc. (KCI), a wound care management company, said the Patents Court of England and Wales in its decree on KCI's patent infringement case against Smith & Nephew Plc. (Smith & Nephew), a UK-based medical devices company, indicated that important claims in the KCI patent covering the use of foam dressing kits with NPWT systems are valid. Kinetic said the court ruled that Smith & Nephew's foam-based NPWT dressing kits infringe the patent claims.

FDA, FTC Warn Public Of Fraudulent 2009 H1N1 Influenza Products

The US Food and Drug Administration (FDA) and the Federal Trade Commission (FTC) are alerting the public to be wary of Internet sites and other promotions for drugs, devices or vaccines that claim to diagnose, prevent, mitigate, treat or cure the 2009 H1N1 influenza virus. The agencies are also advising operators of offending Web sites that they must take prompt action to correct and/or remove promotions of these fraudulent products or face enforcement action.

AGS Announces New Guidelines To Improve Pain Management, Quality Of Life, And Quality Of Care For Older Patients

The American Geriatrics Society (AGS) released new guidelines from their Annual Scientific Meeting in Chicago, Illinois addressing the pharmacological management of persistent pain in older persons. Persistent pain is common among older people, especially those suffering from degenerative spine conditions, arthritis, nightly leg pain or pain as a result of cancer.

Johnson Bottini Files Class Action Lawsuit Against Sequenom

Johnson Bottini, LLP has filed a class action lawsuit in US District Court for the Southern District of California on behalf of all persons who purchased or otherwise acquired securities of Sequenom, Inc. (Sequenom), an in vitro diagnostics company, between June 4, 2008 and April 29, 2009. The complaint alleges that Sequenom and certain of its executive officers violated Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 by issuing false and misleading statements.

CHIME Weighs In On Meaningful Use Definition

The College of Healthcare Information Management Executives (CHIME) provided its statement on the definition of “meaningful use of health information technology” to a hearing of the National Committee on Vital and Health Statistics, an advisory body to the Department of Health and Human Services. Compliance with this definition will determine whether hospitals and group practices qualify for Medicare and Medicaid financial incentives under the American Recovery and Reinvestment Act.

Allergan Posts Net Earnings Of $45 Million For Q1 2009

Allergan, Inc. (Allergan), a US-based medical device company, has reported total revenues of $1 billion for the first quarter of 2009, down compared with the total revenues of $1 billion in the year-ago quarter. It has also reported net earnings of $45 million, or $0.15 per diluted share, for the first quarter of 2009, compared with the net earnings of $107.9 million, or $0.35 per diluted share, in the year-ago quarter.

Osteotech, Inc. (Osteotech), an orthopedic devices company, has reported revenue of $23.93 million for the first quarter of 2009, up 4%, compared with the revenue of $27.63 million in the year-ago quarter. It has also reported a net income of $1.8 million, or $0.10 per share, for the first quarter of 2009, compared with the net income of $0.80 million, or $0.05 per share, in the year-ago quarter.

It has also reported a net loss of $48.6 million, or $0.38 per diluted share, for the first quarter of 2009, compared with the net loss of $103.3 million, or $0.76 per diluted share, in the year-ago quarter.
